How New York taxes a car purchase
- Trade-in: Dealer sales: the trade-in credit is deducted from the taxable amount when the dealer takes the trade-in for resale. Private sales: tax is on the total consideration (cash + debt assumed + value of property traded).
- Private sale: Buyer and seller complete DTF-802; the DMV collects sales tax at the rate where the new owner lives. If the price is below fair market value (and the seller isn't a spouse, parent, child, stepparent or stepchild) the seller must sign an affidavit; the Tax Department may establish fair market value.
- Bought in another state: New York gives a credit for sales tax paid to another state only where that state gives New York the same credit; whether your other state qualifies depends on its rules. See NY Tax Bulletin TB-ST-765.
- Local tax: County/city rate from Publication 718 (local = combined minus 4%; MCTD counties include 3/8%). For vehicles the rate is where the buyer lives (individuals), not where the dealer is, if the buyer gives the dealer Form DTF-820.
Exemptions (check the official rule before relying on one)
- Gift or purchase from spouse, parent, child, stepparent or stepchild: Use DTF-802.
- Nonresident at time of purchase: Use DTF-803.
- Military personnel who bought outside NY while in service: Exempt if tax paid to another state, or deferral while stationed outside NY.
- Settlement of an estate: Acquired in settlement of the previous owner's estate (not bought from the estate).
Dealer fees
Doc, processing and prep fees are set by the dealer, not the state. New York sets a maximum documentary fee of $175.00. Dealer charge for processing registration (optional, dealer-set, not a DMV fee); DMV caps it at $175.
